General Terms and Conditions

Scope

These General Terms and Conditions (GTC) apply to purchase contracts with private customers and companies that are concluded via the website www.brickgloria.ch.

Contractual partners, conclusion of contract

You place an online order in the shop.
You can initially place our products in your shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the order process. By clicking on the order button, you are placing a binding order for the goods contained in the shopping cart.
Each order is confirmed. The contract is deemed to have been concluded as soon as you receive the order confirmation.
The languages available for the conclusion of the contract are German and English.

Scope of the items

Our online offer is subject to change and non-binding. Changes in color, appearance, quality, and prices are subject to change.
Terms and conditions other than those described here shall only apply if we have confirmed them in writing in advance. We reserve the right to make technical changes to items, printing errors, price errors, and delivery options.

Prices

All prices are quoted in Swiss francs (CHF). The currently applicable value added tax and advance recycling fees as well as processing are included.
We reserve the right to change prices at any time. The prices published on the website on the date of the order apply to customers.
Shipping costs are charged extra and are shown separately.

Delivery conditions and collection

Delivery is generally made worldwide. Exceptions are countries subject to trade restrictions. We deliver by post with Swiss Post.
Delivery is usually made within 2-5 working days after receipt of payment confirmation.

Right of return

If you are not satisfied with the delivery or individual items in the delivery, or if you have ordered the wrong item by mistake, you have the right to return the item within 10 working days.
Items or shipments will only be accepted under the following conditions: The items must be in perfect condition and in their original packaging. The packaging of the items must not have been opened. The seals must be intact.
In the event of a defective delivery (transport damage), the delivery company (post office) must be notified immediately.
The return shipment must be sufficiently stamped so that we do not incur any further costs. We will have to charge you for defective, damaged, and incomplete returns.

Liability and warranty

Brickgloria guarantees for a period of 2 years that the goods have the characteristics promised, have no defects that impair their value or suitability for the intended use, and comply with the specified performance and specifications. The warranty period begins on the date of purchase.
The buyer must inspect the delivered goods as soon as possible and report any defects immediately. Hidden defects can also be reported after the goods have been put into operation or used. Payment does not constitute a waiver of the right to report defects.
Warranty claims on your part will be settled as quickly as possible by replacement delivery or repair of the defective item(s). In the event of improper handling or personal intervention, your warranty claim shall expire. The warranty claim is not transferable to third parties.
Brickgloria accepts no liability for any damage or consequential damage that may occur during operation or play, as we cannot control or monitor proper operation or play.
Our items comply with the safety standards of the toy industry.
Our items are not suitable for children under 3 years of age. Choking hazard due to small parts that can be swallowed.

Payment

Payment can be made in the following ways at the customer's request:

By prepayment (bank or postal transfer): You will receive the necessary invoice details by email. The goods will be reserved and shipped on the next working day after receipt of payment.

By credit card: The credit cards listed in the webshop are accepted. The price communicated in the shop at the time of shipment of the goods will be debited. Your purchase and credit card transaction are SSL-encrypted and therefore secure.

PayPal: Customers do not incur any additional fees when paying via PayPal.

Liability for online connections

Brickgloria undertakes to ensure state-of-the-art security in systems, programs, etc. that it owns and over which it has influence, and to comply with data protection regulations.
Customers are responsible for ensuring the security of the systems, programs, and data within their sphere of influence. In their own interest, customers should keep passwords and user names secret from third parties.
Brickgloria is not liable for defects and malfunctions for which it is not responsible, in particular for security defects and operational failures of third-party companies with which it cooperates or on which it depends.
Furthermore, Brickgloria shall not be liable for force majeure, improper handling and disregard of risks on the part of the customer or third parties, excessive strain, unsuitable operating materials of the customer or third parties, extreme environmental influences, interventions by the customer or disruptions by third parties (viruses, worms, etc.) that are possible despite the necessary current security measures.

Place of domicile and jurisdiction

The place of performance and jurisdiction for both contracting parties is the registered office of Michael Gertsch in Unterseen BE/Switzerland.

Swiss law applies, in particular the Swiss Code of Obligations (OR).

The goods remain our property until they have been paid for in full.
